You will need to apply for a renewal or change the status of residence for an already employed foreign national depending on the situation and the period of stay.

If the employee’s residence period is about to expire soon, filing the “application for renewal” will extend the period of residence if the employee will continue to be employed. The “change status of residence’’ application will be needed depending on the change in the employee’s circumstance. For example, if you have had a status of residence as “Spouse or Child of a Japanese national” or “Spouse or Child of a permanent resident” and recently divorced, you will need to change the residence status. Another example would be if foreign nationals who have been working with the “Engineer/Specialist in Humanities/International Services” visa will have to apply for a change if they have satisfied the requirements for the “Highly-Skilled Professional” visa. The highly skilled professional visa holder can receive various preferential treatments with higher qualifications.

If you are married or getting married to a Japanese national or permanent resident, you are free to decide if you would like to change your existing residence status or apply for the spouse residence status. However, if you have divorced, you will need to change your spouse-related visa status.. If the visa expires during any of the situations above, scheduled management and understanding of required documents are extremely important. If the application is not completed before the visa expires, the foreign national will have to leave the country upon expiration of their visa.

Even after you have applied, if any of the required documents are missing, the application for change will not be accepted and the foreign national will lose their residence status. For this reason, one should always pay attention to the residence status of their foreign employees.

Notification when a Change Occurs

If a foreign employee who’s residence status is based on a marital relationship has a filed for divorce, they must also submit a “Notification Concerning the Spouse” within 14 days from the date of divorce. If there is a change in the name or address of your company or employer, you will also need to submit a “Notification Concerning the Contracting Organization” within 14 days from the date of change.
