A residence card will be issued to foreigners who have stayed in Japan for more than three months (medium- to long-term residents). The residence card has a valid period, and if you stay in Japan beyond the valid period (term of stay), you will be considered overstaying regardless of how many days it has been since the expiry of your residence card. If you plan on staying in Japan after your current residence status expires, you must always apply for a “renewal” or “change” in residence status.
Staying illegally is punishable by imprisonment with or without work for up to 3 years, or a fine of up to 3 million yen, and in some cases both. There is also the possibility of deportation, and depending on the case, you will not be able to enter Japan even for tourism purposes for 5 or 10 years from the date of deportation.
If the period of stay expires and the foreign national must leave Japan, this could hinder the business operations of the employer who will need to continue the business without that foreign employee.
Some people may think that if your residence status has expired and you decide to leave the country, you will be able to apply and regain your status of residence to re-enter Japan immediately. However, this is a false statement.
When renewing your status of residence, the general examination period is about 2 to 4 weeks. On the other hand, obtaining a new status of residence would generally take 3 to 4 months for the application to be reviewed. Furthermore, depending on when and where the application was filed, the examination may take as long as half a year. It is also important to note that preparing all the documents required for new applications (which are not the same as documents required for renewals) will consume more time.
Once the renewal or change application has been approved, the last step of the process is receiving the new residence card at the Immigration Services Agency in Japan. However, visa issuance procedures (new applications) are made at the Japanese embassy or consulate of your country of residence. The period required for visa issuance varies depending on the country, region, and the applicant themselves. You may receive your residency status after your visa has been issued and you have entered Japan. Though it is possible for it to be issued on the same day, it may also take several days or even weeks. If your residency status has expired and you plan on renewing, this can take up to 3 months.
In these cases where the employee loses their residency status, the employee would not only lose their income, but this would also interfere in the employer’s business, resulting in a loss for both parties.
In order to prevent these situations from occurring, it is important to strictly manage the residency statuses of foreign employees. This can be tiresome and time consuming to have to check the validity daily. As a result, both the employer and their foreign employees often forget to renew or change their residence status. Even if they manage to notice the residence status expires soon, it may already be too late to prepare all the documents and process the application.
